Mazhilis approves bill giving new responsibilities to private bailiffs

Private bailiffs will be required to cancel previous rulings on coercive measures. In particular, if a citizen has paid off all debts. The Mazhilis of the Kazakh Parliament approved in the first reading a bill aimed at improving enforcement proceedings. In addition, the amendments are proposed to reduce the list of the grounds for summoning the debtor to the bailiffs. Overall, the document provides for the elimination of gaps and contradictions in the legislative acts in this area, as well as the norms that promote corruption. It is therefore planned to reduce the number of complaints about the work of bailiffs and ensure the citizens’ rights. The bill was drafted at the initiative of members of the Parliament.

“To establish the obligation of private bailiffs to overturn all rulings on enforcement measures issued by previous private bailiffs in the framework of enforcement proceedings, reduce the grounds for summoning a debtor to prevent corruption offenses, establish the obligation of private bailiffs to send a copy of the ruling on initiating enforcement proceedings and notify of enforcement measures execution,” said Dmitry Koloda, a member of the Mazhilis, the Lower House of the Kazakh Parliament.
